For the purposes of these General Terms and Conditions of Sale, the following are considered as:
The use of the Websites, as well as any order addressed to the Circuit de Spa-Francorchamps necessarily imply, as an essential and determining condition, the unreserved acceptance of the General Terms and Conditions of Sale by the Client, which are the only ones applicable, to the exclusion of any other, unless expressly stipulated otherwise. Only persons of legal age and capacity may place an order.
The Circuit de Spa-Francorchamps reserves the right to modify the General Terms and Conditions at any time. The applicable General Terms and Conditions are those in force on the date of the order or use of the Website. It is recommended that the Client print and/or save a copy of the applicable General Conditions when placing an order.
In case of discrepancy between the different language versions of the General Terms and Conditions, the French version shall prevail.
Prices and payment
Unless otherwise stated, the prices displayed on the Websites are inclusive of all taxes, excluding delivery costs. Prices include a 7% administration fee.
Prices in foreign currencies are displayed for information purposes only. The price in euro is the official price. The price in foreign currency may vary according to the conversion rate applied by the financial institutions on the day of the order. No claim will be accepted due to this variation. All costs related to the transaction in a foreign currency are to be borne by the Client.
The Circuit de Spa-Francorchamps reserves the right to modify its prices at any time, notably to include any new tax that may be applicable. The Tickets will be invoiced on the basis of the prices in force at the time of the order confirmation.
Promotional codes and other discounts are only valid for the period advertised and subject to compliance with the conditions set out. They cannot be combined for a cumulative effect.
Payments can only be made via the payment methods provided on the Websites and are subject to compliance with the terms of use of these methods.
For all orders, prompt payment is required (all transactions made with credit and debit cards are charged at the time of purchase) and any late payment will imply, by right and without notice, the payment of interest of 2% per month on the outstanding amount from the due date of the invoice until full payment, as well as compensation of 15% of the amount due, with a minimum of €150. Notwithstanding Article 1583 of the Civil Code, the Tickets remain the exclusive property of the Circuit de Spa-Francorchamps until full payment of its invoices. Notwithstanding this reservation of ownership, all risks of loss and damage are transferred to the Client upon taking possession.
In order to place an order via the Websites, it is necessary to follow the relevant process and to provide certain information (including a billing address, a valid e-mail address, a telephone number, etc.). Each Client is solely responsible for the information provided and its accuracy. If it is possible to create a client account, the Client must ensure that the account is protected against fraudulent use. This protection should include the use of a sufficiently strong and strictly confidential password. In the event of any fraudulent use of their account, the Client must inform the Circuit de Spa-Francorchamps as soon as possible.
A Client who places an order for a third party is considered the ordering party and is responsible for the payment of the order. The Client must also ensure that the third party is informed of the content of the General Terms and Conditions and their application.
Before processing an order, the Circuit de Spa-Francorchamps reserves the right to check the Client data and to request additional information. The Circuit de Spa-Francorchamps reserves the right to refuse any order, at its sole discretion and in particular for reasons such as security concerns (hacked account), fraud (minors or persons lacking capacity), error (unknown address), and commercial transaction (professional client, purchase for resale purposes, etc.). If the Client has placed an order in breach of the provisions of the General Terms and Conditions, the Circuit de Spa-Francorchamps reserves the right to claim damages.
Once the order has been confirmed and paid in full, a confirmation e-mail will be sent to the Client. This e-mail must be kept by the Client.
The Tickets offered are subject to availability. If necessary, the Company may change the category of the Ticket ordered to an equivalent or higher category, at no additional cost to the Client, who will be notified of the changes by e-mail.
In the event of refusal or impossibility to carry out the order, the Client will be informed as soon as possible and the sums already paid will be reimbursed as soon as possible and, at the latest, within 14 (fourteen) days of the refusal of the order.
Tickets are sent to the Client electronically (either by e-mail or by making them available on the client account created on the Websites), at the latest the week preceding the Service.
Delivery times are provided for information purposes only and are calculated only from the date of actual receipt of the Client's payment. Any delays in delivery cannot give rise to damages or any reimbursement.
The Client alone is responsible for the delivery data provided and must provide all relevant information (including a valid e-mail address). If the data provided by the Client to the Circuit de Spa-Francorchamps are incomplete and/or inaccurate, the Circuit de Spa-Francorchamps cannot be held responsible for the inability to send the Tickets.
Any dispute relating to the price must be formulated in writing and addressed to the registered office of the Circuit de Spa-Francorchamps, within 7 (seven) days of the payment and/or issue of the invoice. Unless otherwise stipulated, the invoice will be sent to the Client by e-mail.
Under penalty of forfeiture, any complaints must be formulated by the Client as soon as possible and at the latest within 2 (two) months from the date of discovery of the non-conformity and must be accompanied by a copy of the invoice and be duly documented and justified.
Right of withdrawal (only applicable to consumers)
In terms of Activities, the Client does not have the right of withdrawal provided for in Art. VI. 47 of the Code of Economic Law, in accordance with Article VI. 53, 12° of the Code of Economic Law, which prevents the exercise of this right for service contracts related to leisure activities if the contract provides for a specific date or period of execution.
For orders made for activities not referred to in Article VI.53,12° of the Code of Economic Law, the Client has a period of 14 (fourteen) days to withdraw from the contract, without having to give reasons for this decision and without incurring any costs other than those of delivery, in order to return the Ticket to the registered office of the Circuit de Spa-Francorchamps. The period of 14 (fourteen) days begins on the date of delivery of the Ticket. After this period, the Circuit de Spa-Francorchamps will no longer be able to accept the return.
To exercise this right of withdrawal, the Client must inform the Circuit de Spa-Francorchamps of this decision in writing, with an acknowledgement of receipt, before the expiry of the 14 (fourteen) day period, by one of the following means:
A Client exercising their right of withdrawal must return the Ticket to the Circuit de Spa-Francorchamps, at the latest 14 (fourteen) days after the communication of the decision to withdraw from the contract. The Client shall bear the direct costs incurred by the return of the Ticket, as well as the risks associated with this return.
Should the Client use the Ticket before the expiry of the 14 (fourteen) day period, he/she waives his/her right of withdrawal. The returned Ticket must be accompanied by the invoice and the delivery slip, if applicable. Any return where the sender cannot be identified will be refused.
The refund of the order will take place within the 14 (fourteen) days following the day when the Circuit de Spa-Francorchamps is informed of the Client's decision to withdraw from the contract exercised in accordance with the present article, using the same means of payment as the one used for the initial transaction, and on condition that all the terms of return have been strictly respected and that the Circuit de Spa-Francorchamps has recovered the Ticket. The amount refunded will in any case be limited to the amount actually paid by the Client. If the Client chooses a delivery method other than the less expensive standard delivery method offered by the Circuit de Spa-Francorchamps, the latter shall not reimburse any of the additional delivery costs.
Access to the Facilities is only possible upon presentation of a valid Ticket. This access is forbidden and/or may be refused, at the sole discretion of the Circuit de Spa-Francorchamps (or of the entities to which the management of the Facilities has been entrusted) in the cases mentioned below, without this list being exhaustive, if the person holding the Ticket:
In addition, in order to access the Facilities and Activities, the Ticket holder must agree to undergo any safety checks provided for at the entrance and comply with the applicable legal rules in force on the day of the Event, including for minors (e.g.: Covid Safe Ticket). Otherwise, access to the Facilities will be denied. It is the responsibility of the Ticket holder to find out about the measures in force on the day of the Activity, at the Company's entire discretion.
In the cases referred to above, no refund, restitution, indemnity or compensation whatsoever may be claimed from the Company.
Conditions of access may be subject to change. Prior to each order and before the actual date of the Activity, the Client is required to check the Websites for the exact dates, access conditions, etc., and to ensure that the Activity is not subject to any particular cancellation or restriction.
While using the Facilities, the Client shall respect the environment and nature, by maintaining the cleanliness and only disposing of waste at the designated waste collection points. Any behaviour to the contrary may be penalised and be grounds for exclusion.
For certain Activities, the Company may impose a minimum age and specific access conditions:
Persons who do not meet the required conditions cannot participate in the Activities.
No refund, restitution, indemnity or compensation of any kind may be claimed for any Activity that cannot be carried out due to non-compliance with the age thresholds and conditions set.
The Circuit de Spa-Francorchamps reserves the right to refuse access to a Client who arrives late (after the scheduled Activity time or time slot), even if the Client is in possession of a valid Ticket.
All persons access the Facilities and participate in the Activities at their own risk and are informed of the possible occurrence of injury (such as hearing damage, physical disorders or eye damage).
Clients shall respect the safety instructions and be adequately equipped.
Responsibility
Tickets offered for sale on the Websites are accompanied by a description provided by the Circuit de Spa-Francorchamps and may be illustrated with photographs, which have an illustrative value and are not contractual. The Circuit de Spa-Francorchamps cannot be held responsible for any errors that may appear in the texts and photos used in the description on the Tickets.
The Circuit de Spa-Francorchamps shall not be considered liable in the event of damage and/or direct or indirect prejudice (operating loss, loss of profit, loss of opportunity, etc.) that may result from a delivery problem (due to force majeure, restrictions imposed by the authorities, refusal to import/export, etc.) or from damage during the Activity, except in the case of fraud or gross negligence on its part or gross negligence on the part of its employees and agents. In the event of personal injury (including death), the Company may only be held liable if the injury results from an act or omission on its part.
The Circuit de Spa-Francorchamps shall not be considered liable in the event of incomplete delivery data and/or refusal to take delivery.
As regards the Websites, Clients use them at their own risk. The Circuit de Spa-Francorchamps provides the Websites as they are, with all their faults and as available. The Client acknowledges and accepts that IT and telecommunication systems are not free of defects and that it is possible to suffer interruptions in service. The Client remains solely responsible for the information he/she transmits via the Websites and for the subsequent outcomes. The Circuit de Spa-Francorchamps assumes no responsibility for the information provided by the Client when creating an account and/or any other information encoded via the Websites by the Client. The Circuit de Spa-Francorchamps shall not be considered liable in the event of loss and/or disclosure to third parties of information communicated by the Client via the Websites. The Circuit de Spa-Francorchamps cannot guarantee that the transmission of data via the Websites or other telecommunications systems is not monitored, recorded or distorted by third parties. Furthermore, the Circuit de Spa-Francorchamps accepts no responsibility for the content of third-party sites to which it establishes a hypertext link, in particular with regard to privacy protection.
Consumer protection regulations are applicable in terms of the relationship between the Circuit de Spa-Francorchamps and a consumer. The responsibility of the Circuit de Spa-Francorchamps cannot be extended beyond the mandatory provisions provided for in the law (Book VI. Market practices and consumer protection of the Code of Economic Law).
In any event, the liability of the Circuit de Spa-Francorchamps remains in all cases limited to the amounts paid for the order which generated the call upon the liability of the Circuit de Spa-Francorchamps.
In the event of cancellation or postponement of the Activity, at the initiative of the Circuit de Spa-Francorchamps, the Client may request a refund of the price or a voucher. No reimbursement will be made for gift vouchers.
The cancellation or postponement will be communicated via the Websites.
This article does not apply if the Client is unable to attend the event because he/she does not comply with the conditions of access imposed (e.g. vaccination status). Clients should refer to Article 8.
No reimbursement or compensation of any kind can be made if the Client wishes to cancel an order for reasons related, for example, to terrorist threats and/or attacks or for health reasons.
The Circuit de Spa-Francorchamps cannot be held responsible for the total or partial non-performance of the Activity, its cancellation or postponement and/or delivery problems, in case of force majeure or acts of God such as, in particular, disturbances or total or partial strikes, blocking of road access and means of transport and/or communications, flooding, fire, accident, pandemic, lock-down, etc.
The Circuit de Spa-Francorchamps retains exclusive ownership of all intellectual property rights relating to the Activity and the Tickets (brand, logo, design, etc.). Consequently, any reproduction or imitation in any form whatsoever and by any process whatsoever is strictly prohibited.
It is also forbidden to resell the Tickets or to procure them for third parties in any way whatsoever for commercial purposes, except for companies expressly mandated by the Circuit de Spa-Francorchamps and which have signed a mandate contract with it.
Any Ticket purchased in violation of this clause will not give access to the Facilities and/or the Activity and may be cancelled by the Company. The Circuit de Spa-Francorchamps also reserves the right to check the identity of the Ticket holder and/or the sales intermediary.
In the event of a breach of any of these prohibitions, the Client shall indemnify the Company for any damage suffered by the Company.
The Circuit de Spa-Francorchamps also reserves the right to immediately stop any commercial practice that violates any of the prohibitions provided for in this clause and to seize or have seized the material that is the object of plagiarism, counterfeiting, copying or reproduction of any kind, as well as to seek damages (of a minimum of €1,000 per counterfeit or illegally resold ticket).
Image rights
By accessing the Facilities and participating in the Activities, all visitors automatically give their consent to be photographed or filmed and hereby authorise the Company to use, publish, exploit and/or disseminate digital images including their personal image.
The Company may use these digital images, linking them to its activities, in any form and on any tangible and intangible medium, known and unknown to date, throughout the world, without limitation of time, for commercial or non-commercial purposes, in full or in part. The commercial and/or media partners of the Circuit de Spa-Francorchamps may also use these digital images and according to the same acceptance as for the Company.
These digital images may be used for prevention and security purposes by the authorities and forces of law and order in accordance with the law of 21 March 2018 amending the law on the role of the police, for the purpose of regulating the use of cameras by the police authorities, and amending the law of 21 March 2007 regulating the installation and use of surveillance cameras.
On the other hand, images filmed by visitors on the site of the Circuit de Spa-Francorchamps may not be used for commercial or public purposes without the prior written authorisation of the Company and/or the organiser of the event if it is not the Company.
Information provided by the Client is only used by the Circuit de Spa-Francorchamps for the purpose of processing the order and for access to the Facilities and/or the Activities.
The Circuit de Spa-Francorchamps shall process the personal data, except for the financial data provided by Client to carry out online payment which are only exchanged between the Client, the external partner and the financial institution concerned. The Circuit de Spa-Francorchamps has no access to the Client’s confidential payment data.
Personal data communicated to the Circuit de Spa-Francorchamps are processed for the purposes of client management, which includes the management of pre-contractual and contractual relations, as well as the use of the data for direct marketing purposes. The Client may object, on request and free of charge, to the processing of his/her data for direct marketing purposes. At any time, the Client may request the modification of his/her personal data, deactivate his/her account and/or request its deletion by sending a specific request to the Circuit de Spa-Francorchamps. The Circuit de Spa-Francorchamps may also delete an account or refuse to register an account without having to justify itself.

In order to ensure safety and public order, all persons using the Facilities must obey the instructions and directives of the Company or its representatives at all times.
Security staff in charge of security and access to the Facilities may check the identity of visitors and the validity of their Tickets before they are admitted to the Facilities.
Searches may also be carried out, in accordance with the regulations in force. If objects that may endanger the safety of the Facilities and/or visitors are found, security staff will have the right to confiscate the object(s) and/or to refuse their owner access to the Facilities.
The invalidity of any provision of the General Terms and Conditions shall have no influence on the validity of the other provisions of the General Terms and Conditions and shall not invalidate such provisions.
No failure or delay on the part of the Circuit de Spa-Francorchamps in exercising any right under the General Terms and Conditions shall be deemed a waiver or cause the loss of such right. Any waiver of any right arising from the General Terms and Conditions must be expressly stated in writing by the Company.
The Circuit de Spa-Francorchamps may assign, transfer or otherwise dispose of its rights and obligations, in whole or in part, at any time and without notice. This waiver may not prejudice the Clients.
The entire content of the Platform (including texts, photographs, etc.), is protected by copyright, trademark law and other intellectual property rights. These elements are the property of the Circuit de Spa-Francorchamps or of other third parties with whom the Circuit de Spa-Francorchamps has concluded agreements. Therefore, any copy, publication, reproduction or any other exploitation, counterfeiting in any form whatsoever, is prohibited without prior written authorisation. Any infringement may result in civil and/or criminal proceedings.
The relationship between the parties is governed by Belgian law. In the event of a dispute, in particular concerning the services provided by the Company and the validity, interpretation or implementation of the General Terms and Conditions and any act arising therefrom, only the Courts and Tribunals of the registered office of the Circuit de Spa-Francorchamps shall have jurisdiction. The language of the proceedings shall be French.
In the event of a dispute, the data recorded electronically by the Circuit de Spa-Francorchamps shall be deemed authentic and may be used as evidence to demonstrate the materiality of the transactions concluded between the parties.
